1. Acceptance of Terms
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Bail Bond Portal ("we," "us" or "our"), concerning your access to and use of the Bail Bond Portal website and electronic bail bond transmission services.
By accessing or using our service, you agree to be bound by these Terms of Use. If you disagree with any part of these terms, you may not access our services.
2. Eligibility
Our services are available only to licensed bail agents operating within their jurisdiction. By using our services, you represent and warrant that:
- You are a licensed bail agent in good standing in the jurisdiction(s) where you operate
- You have registered for each county you represent
- You have the authority to act on behalf of any entity you claim to represent
- You are at least 18 years of age
- Your use of our services does not violate any applicable law or regulation
3. Account Registration
To access our services, you must register for an account. When you register, you agree to provide accurate, current, and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Promptly notifying us of any unauthorized use or security breach of your account
We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete.
4. Service Description and Fees
Bail Bond Portal provides an electronic transmission service that facilitates the transfer of bail bond documents from licensed bail agents to jails. While registration for an account is free, we charge a transmission fee of $2.00 per defendant. This fee allows for the transmission of multiple powers or documents related to a single defendant's case.
Credits must be pre-purchased through your account dashboard and are available in increments of 10, 20, 50, or 100. All fees are non-refundable, including in cases where transmission errors occur. It is your responsibility to verify all information before submission.
5. User Responsibilities
When using our services, you agree to:
- Maintain all required professional licenses and credentials
- Provide accurate and complete information for all transmissions
- Verify all information before submitting transmissions
- Comply with all applicable laws and regulations
- Ensure that all submitted documentation meets the requirements of the receiving jail facility
- Maintain proper security protocols to protect your account and sensitive information
- Not engage in any fraudulent, deceptive, or unlawful activities
- Use the service in only one browser tab and one browser window at a time; multiple simultaneous sessions are prohibited
- Not resubmit bond documents to a jail facility after they have already been successfully transmitted
Violation of the above requirements regarding simultaneous sessions or duplicate submissions may result in account suspension, and any credits used or remaining in your account will not be refunded.
6. Limitations and Service Availability
While we strive to ensure continuous availability of our services, we do not guarantee uninterrupted access. In the event of service interruptions, you acknowledge that bonds can still be submitted through traditional methods directly to the jail facility.
We have no control over the release times for defendants, as each jail operates independently and follows their own procedures and timeframes. Our service merely facilitates the transmission of required documents to the jail facility.
7. Intellectual Property
The Bail Bond Portal website, its original content, features, and functionality are owned by Bail Bond Portal and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent.
8. Disclaimer of Warranties
Your use of our service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We make no warranty that:
- The service will meet your requirements
- The service will be uninterrupted, timely, secure, or error-free
- The results that may be obtained from the use of the service will be accurate or reliable
- The quality of any information or service obtained through our platform will meet your expectations
9. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Bail Bond Portal or its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the service
- Any conduct or content of any third party on the service
- Any content obtained from the service
- Unauthorized access, use, or alteration of your transmissions or content
Our liability is limited to the amount you paid for the specific transmission in question, or $2.00, whichever is less.
10. Indemnification
You agree to defend, indemnify, and hold harmless Bail Bond Portal and its licensees, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use or your use of the service.
11. Termination
We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms of Use.
Upon termination, your right to use the service will immediately cease. All provisions of these Terms of Use which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to or use of the service shall be instituted in the courts of the State of Florida.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time. The most current version will be posted on our website with the "Last Updated" date. Your continued use of the service after any such changes constitutes your acceptance of the new Terms.
